Brady O’Malley, Esq., defended a local business in Oneida County during a four-day jury trial before the Honorable Norman I. Siegel, A.J.S.C. The plaintiff missed a five-inch drop down/step located immediately inside the side entrance of the defendant’s business. Consequently, she fell and sustained multiple leg fractures requiring surgery. The plaintiff and her expert engineer alleged the drop down/step violated New York State Codes, Rules and Regulations and constituted an inherently dangerous and trap-like condition. After a short deliberation, the jury reached a unanimous defense verdict finding no negligence against the defendant.
