Eric G. Johnson, Esq., successfully defended a local physician in a medical malpractice claim in Oneida County. Plaintiff patient alleged medical malpractice stemming from uro-gynecologic surgery. Plaintiff claimed the defendant doctor was negligent by ligating the patient’s right ureter intraoperatively, failing to identify and correct the problem intraoperatively, and failing to diagnose the problem by virtue of the patient’s symptoms in the post operative period. The ureteral obstruction was discovered a year later during another GYN surgery, at which time it was determined that the obstruction was chronic and had resulted in “death”/the complete loss of function of the right kidney.
The trial was in Oneida County Supreme Court, with Judge Erin Gall presiding. The jury returned a verdict in favor of the physician. Great work Eric!
