Daniel R. Ryan, Esq., represented a nurse practitioner in a medical malpractice and wrongful death action in Oneida County. Plaintiff’s claims were failure to diagnose colon cancer in the plaintiff’s decedent. More specifically plaintiff claimed defendant failed to pick up on low blood values, weight loss, symptoms of anemia and other signs of cancer. During the trial, the defendants demonstrated that no such symptoms were present or reported to the defendant health professionals, and that there were, in essence, no signs or symptoms consistent with a cancer process. After an 8-day trial before Judge Clark, the jury was out less than an hour and returned a verdict in favor of the defendants.
