The plaintiff fell on a ramp while exiting the defendant’s store. She sustained a bimalleolar ankle fracture for which she underwent open reduction and internal fixation surgery. The plaintiff’s expert testified the defendant’s ramp was a hazardous condition because it was in a state of disrepair, excessively steep, had no handrails and violated several provisions of the NYS building code and national safety standards. After 40 minutes of deliberation, the Ulster County jury returned a unanimous verdict finding no negligence against the defendant.
