Cahalan Wins Difficult GML 205-e case in Westchester Supreme Court

Bob Cahalan obtained summary judgment for a contractor defendant on a complex claim under General Municipal Law Section 205-e which is a plaintiff-friendly statute intended to afford law enforcement officers a far greater chance of recovery in a civil action when injured in the line of duty. The officer merely needs to demonstrate that the injury was directly – or indirectly – caused by a violation of New York State or Federal law. Bob attacked the cause of action on multiple fronts and won the dismissal. He also secured dismissal of a related action as untimely by the police department to recover amounts it paid to the officer under GML 207-c.
