John Coghlan secured a full defense verdict on behalf of two orthopedic surgeons and their practice in Onondaga County Supreme Court in a medical malpractice case alleging an unnecessary total hip replacement. Plaintiff claimed that the defendant physicians misdiagnosed his right hip condition and performed a total hip arthroplasty that was not indicated, and that his persistent post-operative pain was attributable to a separate soft tissue condition that should have been identified and treated conservatively before any surgery was recommended.
Through the use of the medical records, imaging, and successful cross-examination of Plaintiff and his expert, John was able to demonstrate to the jury that the plaintiff presented with objective radiographic evidence of severe end-stage osteoarthritis of the right hip, including bone-on-bone contact, complete joint space obliteration, and a misshapen femoral head, and that the decision to proceed with surgery was consistent with accepted orthopedic standards of care. After deliberating for approximately 90 minutes, the jury returned a unanimous verdict in favor of all defendants.
