Dan Ryan and Chris DeFrancesco Win Summary Judgment

Dan Ryan and Chris DeFrancesco obtained summary judgment for a North Country area hospital. The plaintiff alleged that the hospital negligently granted privileges to the co-defendant physician who performed surgery on the plaintiff. Dan and Chris successfully argued that the hospital had proper credentialing procedures in place, and that it followed those procedures when it granted privileges to the physician. Merely providing a facility for a licensed credentialed physician to perform surgeries does not give rise to vicarious liability.
