Partner Dan Ryan recently secured a defense verdict in a dental malpractice case in Onondaga County Supreme Court. Plaintiff alleged the doctor defendant had improperly performed a root canal on the wrong tooth which caused TMJ symptoms, among other things.
Dan successfully convinced the jury that performing the “wrong tooth” root canal was not malpractice and did not cause the plaintiff any damages. After almost a day of deliberation, the jury returned a unanimous verdict finding the doctor did not deviate from the standard of care.
