Dan Ryan Wins Summary Judgment in Federal Court (WDNY)

Plaintiff claimed she fell in our client’s store as a result of water puddling in the store’s vestibule. The store surveillance video showed that minutes before the plaintiff fell, a sudden, severe rainstorm began. Wind from the storm caused the store’s automatic doors to open, allowing rain to enter the store. The Court dismissed the case finding as a matter of law that defendant did not create the dangerous condition, nor did it have reasonable time to remedy the condition.
