DeFrancesco Wins Another Medical Malpractice Summary Judgment

Chris DeFrancesco obtained summary judgment for a family nurse practitioner in a wrongful death case where it was alleged she failed to timely diagnosis pancreatitis. In opposition to defendant’s motion, plaintiff offered the opinions of a hepatobiliary surgeon but Chris successfully argued the opinions were vague, speculative and conclusory. The Court dismissed the case finding plaintiff’s expert failed to establish a deviation from the standard of care or proximate cause.
