DeFrancesco Wins Summary Judgment in Legal Malpractice Case

Chris DeFrancesco won summary judgment in Monroe County on behalf of an attorney accused of legal malpractice.  Plaintiff hired the defendant to represent it in the sale of rental property and alleged the defendant failed to discover the municipality was in the process of foreclosing on a tax lien resulting in the municipality seizing ownership of the property.  Plaintiff offered the opinion of an independent legal expert who argued the defendant failed to take necessary steps to investigate the impact of the tax lien on the property and discover the municipality intended to foreclose on the lien. Chris successfully argued the opinions of plaintiff’s expert were vague, speculative and conclusory.  Justice Taylor agreed and dismissed the action against the defendants in its entirety.
