A New York Plaintiff brought a medical malpractice case in Steuben County Supreme Court for concerning treatment rendered by the defendant physicians in a Pennsylvania hospital located just across the New York state border. Eric Johnson successfully argued that New York did not have general or specific jurisdiction over the individual defendant physicians or defendant hospital. The Court dismissed the case because there was no connection between the defendants’ treatment and New York State nor did the defendants engage in sufficient activity in New York to impose jurisdiction.
