Eric Johnson won an across the board defense verdict in a medical malpractice arbitration for an orthopedic surgeon, orthopedic PA and hospital in a claim of negligence arising from a total knee replacement surgery and follow up care. Plaintiff claimed the defendants were all negligent in failing to follow proper interoperative anti-infection protocols, and in failing to timely recognize, diagnose and treat the plaintiff’s post-operative prosthetic joint infection, which ultimately required a two stage revision procedure in which the infected prosthetic was removed and, following the implantation of an antibiotic-infused spacer and several weeks of IV antibiotic therapy, a new prosthetic joint was implanted. After two days of testimony, the Judge/Arbitrator returned his verdict in favor of all of the defendants, finding that none were negligent.
