Eric Johnson won yet another unanimous verdict on behalf of his clients, a Nurse Midwife and OBGYN, after a 7-day trial in Onondaga County. Plaintiff claimed the defendants failed to timely diagnose preeclampsia, a disorder of pregnancy that can lead to maternal seizure, stroke or death and fetal injury or death, and failed to properly monitor the mother’s induced labor, which the plaintiff claimed lead to uterine atony and post-partum hemorrhage. As a result of the post-partum hemorrhage, the 33-year-old mother ultimately underwent an emergency hysterectomy, massive transfusions of blood and blood products and ultimately another open surgery to halt the blood flow and save the mother’s life.
In defending the case, Johnson proved that the plaintiff’s claims of negligence were meritless, and that the hemorrhage and subsequent surgeries were unavoidable consequences of the mother’s condition and need for a C-section to deliver her baby safely.
