Karen Krogman Daum secured summary judgment in Onondaga County. Plaintiff slipped and fell during a storm in progress as attested to by defendant’s expert meteorologist. Defendant’s expert orthopedic surgeon also verified that plaintiff’s alleged injuries were not causally related to her fall. The Court found there was a storm in progress and plaintiff’s speculation that she fell on ice that existed before the storm was insufficient to overcome summary judgment. The Court also noted plaintiff did not create a question of fact as to causally related injuries because she failed to submit a treating physician’s affidavit or rebut defendants’ expert proof.
