Landowner purchased property zoned as Agricultural/Residential intending to construct a pole barn for a business boarding horses and providing lessons. After attending a public hearing and multiple zoning board meetings regarding application and requirements for special use permit, the Town commenced an action seeking civil and criminal penalties for alleged violation of a stop work order and alleged operation of a business without the proper permit and certificate of occupancy. After being retained, the violation action was resolved and after all conditions having been agreed upon and met a special use permit and certificate of occupancy was issued allowing the business to move forward with operations.
