Prial Wins Summary Judgment in Labor Law Case

Victor L. Prial, Esq., won summary judgment for a Landlord in Erie County on a Labor Law 240(1) claim.  The plaintiff was the retail tenant’s store manager who was cleaning the windows at the store using an 8-foot stepladder and a squeegee attached to a broom handle.  Plaintiff had positioned the ladder behind himself and climbed the ladder backwards and fell. The court ruled plaintiff’s activity was not covered under Labor Law 240(1) because in this case the window cleaning was a routine maintenance task.
