Steve Williams and Anthony Brighton recently earned summary judgment for a delivery company in a high exposure case. The client’s driver parked a delivery truck on the shoulder of the roadway to make a delivery. Plaintiff argued the truck was parked illegally and was blocking a bike lane/route. The roadway was designated as a “scenic bike route.” Plaintiff, who was riding his bicycle at a high rate of speed, failed to see the delivery truck and collided with the rear of the truck. The trial judge granted our motion for summary judgement, and the Appellate Division affirmed.
