Ted Smith Wins In Traumatic Brain Injury Case

Ted Smith won a unanimous Defense Verdict in a motor vehicle case where plaintiff alleged she suffered a Traumatic Brain Injury. Plaintiff’s alleged injuries included complaints of Post-Concussion Syndrome, Chronic Intractable Headache Syndrome and Traumatically-Induced Epilepsy. Prior to Trial, defendants conceded liability and instead argued plaintiff did not sustain a “serious injury” as defined by NYS Insurance Law. The unanimous Jury agreed after deliberating for less than one hour.
