Victor L. Prial, Esq. secured summary judgment for an attorney as to legal malpractice claims that were asserted as counterclaims in a lawsuit the attorney brought to recover fees earned during representation of a former client against the former client’s prior attorneys, including representation during a trial at which the defendant failed to appear. After a contentious and protracted discovery period, the parties all moved for summary judgment on their asserted claims. The Court granted summary judgment to the plaintiff and dismissed the counterclaims sounding in legal malpractice.
