Chris DeFrancesco and Tom DeBernardis obtained summary judgment in Onondaga County Supreme Court dismissing a premises liability case involving an alleged slip and fall on a defective brick paver located in front of a hotel. The plaintiff claimed the brick paver dislodged when she stepped on it, causing her to fall and sustain significant injuries. DeFrancesco and DeBernardis secured a comprehensive survey of the hotel property that proved the hotel did not own the brick paver and further established the paver at issue was installed as part of a public works project under the control of the municipality. As a result, the Court dismissed the plaintiff’s complaint in all respects.
