Kevin Hulslander and Jaclyn Wanemaker recently won Summary Judgment in a products liability subrogation case in Niagara County Supreme Court. Plaintiff claimed our client manufactured, designed and/or distributed an air purifier that caused a fire in its insured’s home. Defendant showed the court that the purifier was a knockoff and that the defendant was not a proper defendant. Hulslander and Wanemaker moved for dismissal before depositions because of the complete lack of proof the purifier was defendant’s product. The Court agreed and dismissed the Complaint finding any further discovery unnecessary as a matter of law.
